How we work together.

The terms every Webtag client signs, without the legal furniture. What is included, what it costs, who owns what, and how you leave if you ever want to.

The short version

We design, build and manage websites for small businesses in New Zealand. Every client signs a Client Services Agreement before work starts. This page sets out what that agreement says, in plain English. If the two ever differ, the signed agreement is the one that counts.

All prices are in New Zealand dollars. Webtag is not currently registered for GST, so no GST is added. If that changes we will tell you before it affects an invoice.

What you get

Your agreement lists exactly what is in your build: the pages, the design level, the revision rounds, the content we write or source, forms, and any add-ons. That list is the whole job. Anything not on it is extra, and we will always quote it in writing before we start.

We build and manage websites. We do not run advertising, search campaigns, social media or lead generation under this agreement. If you want those, we can point you to people who do.

Paying for the build

Unless your agreement says otherwise, the build fee is paid in two halves: half on signing, half when the site is finished and before it goes live. Small builds can be paid in full on signing.

The deposit holds your slot in our schedule and is not refundable once we have started work, except where the law says otherwise. If you cancel part way through, we keep the value of work done and refund any balance.

The site goes live once the build is approved and paid in full. Invoices are due on the date they show, or within seven days. Overdue amounts can attract interest of 1.5 percent a month, and we may pause the site or dashboard until the account is settled.

What we need from you

Your words, photos, logo and any accounts we need, in a usable form and on time. One named person who can give approvals. If we hear nothing for thirty days we may pause the build, invoice for work done so far, and charge a small fee to pick it back up.

You confirm you own or are allowed to use everything you give us, and you carry the responsibility if that turns out not to be true.

Revisions and sign-off

You get three combined revision rounds. A round is one consolidated list of changes to text, images and minor layout. Extra rounds, or a change of direction after approval, are quoted as additional work.

Approving the design or the finished site, paying the final instalment, or going live all count as sign-off. If we ask for feedback and hear nothing for fourteen days, we may treat the current version as approved.

Going live

For seven days after launch we fix genuine technical faults in our own work, such as broken links, forms that do not send, or display problems on supported browsers and devices, at no charge. Content changes, new features and design changes are not faults.

Hosting and the care plan

Every site we build is hosted on our managed platform, and staying on a Hosting and Care Plan is a condition of the site being live. The plan covers hosting, security and platform updates, uptime monitoring and minor content changes. It is quoted per site and billed in advance.

Because hosting cost follows usage, we may adjust the plan fee if your traffic or media load grows substantially. We give thirty days’ written notice, and you can accept, reduce usage, or leave.

If the plan lapses we may pause the site until it is paid, or treat it as you leaving.

The dashboard

The Webtag dashboard lets you edit your own content, see and manage enquiries, check visitor numbers and view your invoices. It is an optional add-on, priced in your agreement and billed in advance, monthly or yearly.

You can cancel any time, effective at the end of the period you have paid for. When it ends, self-editing and the enquiry inbox switch off, the website itself stays live, and we will give you a one-off export of your enquiries on request. The dashboard is licensed to you while you subscribe; the platform itself stays ours.

Changes after launch

With the dashboard you make your own permitted content changes any time, free. If you ask us to make a change, small ones under an hour, such as prices, hours, contact details, a sentence or an image, are included in your care plan. Bigger changes, new pages, sections or features are quoted first and charged at our standard hourly rate.

If something breaks because of edits, code or tools added outside the dashboard, shared logins, or settings changed against our advice, we will fix it as quoted, chargeable work.

Who owns what

Once the build fee is paid in full, you own your website content: the copy written for you, the layout as delivered, and your branding. Until then it stays ours.

The dashboard, our code frameworks, templates, components and build system stay ours and are licensed to you while you are hosted with us. Stock and third-party assets stay under their own licences.

Unless you tell us otherwise in writing, we may show your site in our portfolio and place a small Built by Webtag credit in the footer, which you can ask us to remove.

Domains and third parties

Your domain name should be registered in your name, and we recommend you control it. Where we manage it for you, we do so as your agent and you stay the owner. We do not provide email hosting unless your agreement says so.

Sites rely on outside services such as hosting, fonts, maps, video and booking tools. Those run under their own terms, and we are not responsible for their outages, changes or prices.

Privacy

Enquiries and customer details your site collects belong to your business, and you are responsible for them under the Privacy Act 2020. We handle them only to run the site and dashboard, host them with reputable providers that may store data outside New Zealand, and tell you without delay if a privacy breach affects your data. Our liability

We work with reasonable care and skill, but we cannot promise a site will be error-free or bring any particular result. Where the law allows, we are not liable for indirect loss such as lost profit or data, and our total liability is capped at the fees you paid us in the twelve months before the event.

If you are buying as a business, the Consumer Guarantees Act does not apply to the extent it can be excluded. If you are buying for personal use, nothing here takes away your rights under that Act or the Fair Trading Act.

Leaving

You are not locked in. After launch you can end the care plan and dashboard on thirty days’ notice, for any reason, with no penalty. With your account paid up we give you an export of your content and a one-off export of your enquiries, and release your domain if we manage it.

The dashboard and our platform code do not transfer, so a new provider may need to rebuild the site on their own system. Help beyond a standard export is available at our hourly rate.

We keep your data for thirty days after you leave, then we may delete it. If we ever stop hosting altogether, we give you at least sixty days’ notice, free exports, and help moving.

Disputes and the law

If something goes wrong we talk first, within ten working days. If that does not settle it, we go to mediation through the Resolution Institute. Either side can still go to court for urgent relief or an undisputed unpaid invoice. The agreement is governed by New Zealand law.

Changes to these terms

Changes to the agreement itself need a signed variation. If we update this summary we change the date at the top. Questions go to info@webtag.co.nz.
